The POSH Act, 2013 mandates every organization having more than 10 employees, to establish an Internal Complaints Committee (ICC) at the workplace, to handle and resolve complaints of sexual harassment. Further, as per the provisions of the POSH Act, each ICC should have one External Member who has a legal or conflict resolution-related background, relevant to the redressal of complaints of Sexual Harassment. The presence of an External Member who has a legal understanding of the POSH Act aids in conducting an inquiry that is methodologic, procedure-orientated, and per the provisions of the POSH Act. An External Member adds value from a neutral perspective, bringing an ethos of fairness and natural justice.
Our External Members are legally trained, experienced, thorough with provisions of the POSH Act, 2013, understand interpersonal dynamics related to work, and are sensitized towards sexual misconduct, and workplace ethics. We aim to bring objectivity to the investigation procedure, adopt a proper method for dispute redressal, conduct an unbiased and fair inquiry, and further assist in the preparation of the final report with recommendations before submission to the Employer.
